A settlement has been reached with Backchecked, LLC (“Backchecked” or “Defendant”) in a class action lawsuit. This case is about the targeted cyberattack on Backchecked's computer systems that occurred in September 2024 (“Data Incident”). Certain files that contained private information may have been accessed. These files may have contained personal information such as names, addresses, dates of birth, Social Security numbers, and driver’s license numbers.
The lawsuit is called Santos, et al. v. Backchecked, LLC, Case No. CV-24-03690-PHX-JJT. The lawsuit is pending in the United States District Court for the District of Arizona (“Action”). Backchecked denies any wrongdoing. No court or other judicial entity has made any judgment or other determination of any wrongdoing by Backchecked. The parties have agreed to settle the lawsuit (“Settlement”) to avoid the costs and risks, disruptions, and uncertainties of continuing the Action.
